A profile of Lesley Curtis our head of Debt Recovery.

What is your specialism?

I’m a Legal Assistant and Head of Debt Recovery dealing with business to business (“B2B”) debt recovery.  In addition, I undertake internal credit control for our four offices.

What qualifications and experience do you have?

I have worked within the debt recovery sector for 23 years and have been Head of Debt Recovery since 2016.   I cover all aspects from pre-issue through to enforcement of County Court Judgments and other Insolvency Proceedings, including Bankruptcy Proceedings and Winding Up Proceedings.

What type of work do you do on a day-to-day basis?

 

 

• Sending letters before action to debtors.

 

• Issuing Court Proceedings against Defendants on behalf of Claimants through CCMCC (County Court Money Claims Centre) and via MCOL (Money Claims Online).

 

• Dealing with defended claims, Admissions and Part Admissions allocated to the Small Claims Track, Fast Track and Multi Track.

 

• Negotiating settlements with debtors and preparing Settlement Agreements where Court Proceedings have not been issued.

 

• Reviewing Terms & Conditions and contractual documentation.

 

• Dealing with Mediation Appointments listed by the Court Mediation Service.

 

• Applying for County Court Judgments (“CCJ”)

 

• Enforcement action undertaken including High Court Enforcement Officers (“HCEO”), Charging Orders, Third Party Debt Orders and Attachment of Earnings Orders.

 

• Preparing Statutory Demands for service by process servers.

 

• Preparing Bankruptcy Petitions.

 

• Issuing Winding Up Petitions.

What is your favourite type of work?

I really enjoy mediation and negotiations and reviewing complex documentation.
In addition, I like to undertake enforcement work.  County Court Judgments are often seen as the final part of the debt recovery process, but they are simply a Court Order which must, often through enforcement action, be converted into money to result in a successful recovery.

Why do you enjoy your work?

I enjoy working hard to obtain the best possible outcome for my clients allowing where appropriate, for the business relationship between the Claimant and the Defendant to be maintained.

I believe that a fair and reasonable approach will often bring about a satisfactory conclusion for both client and debtor and have been instructed by debtor companies following my interactions with them previously, to assist their own companies with debt recovery.
